Contact Form

The personalised trips service, as the name implies, allows the customer to define in full what they want the tour to include. It is a service designed according to your needs and therefore totally personalised.

After accessing the contact form available on the website, the customer must fill it in totally and as complete as possible and send it back to Ataw, which will do the proper follow-up on the request.

We advise that the contact should be made as early as possible, in order to guarantee the best possible rates both in transport, accommodation and respective activities.

Booking

Upon receipt of the contact form, Ataw will respond with some additional questions in order to find out in more detail what goals and budget the customer intends to spend on this experience.

Once confirmed the interest in awarding the service, the customer must deposit 30% of the tour price, within a maximum period of 7 days, sending the respective proof of payment to Ataw's email – hello@atawtravels.com – with personal identification and mentioning the customised tour that is being booked. Only from that moment on, will the process of reservations inherent to the sent order begin.

Full Payment

The entire tour must be paid for up to 60 days before it starts, with its proper supporting payment proof, as mentioned in the topic Booking.

TERMS AND CONDITIONS

CONTRACTING PARTIES

GENERAL

1.1. The Terms and Conditions detailed here contain the entire contract between the interested party and Ataw (Travessioásis – Lda), headquartered at Rua Padre Eloy de Pinho nº8 1ºDireito Ovar, Portugal, registered in the Land / Commercial Registry Office of Ovar with the unique number of the legal person 515 860 085 and RNAVT 9835. This contract can only be amended in writing by a representative of Ataw (Travessioásis – Lda).

1.2. Ataw (Travessioásis – Lda) is an agency that carries out trips with those interested in them, and is not, therefore, a carrier, hotel chain or owner of planes or own hotels. All reservations with carriers, hotels and other service providers are subjected to the terms and conditions and limits of liability imposed by these carriers, hotel chains and other service providers, with whom Ataw (Travessioásis – Lda) has partnerships or resorts in case of necessity. Please note that some of these conditions limit or exclude liability in the event of death, personal injury, delay and loss or damage to luggage, so we do not accept any liability for any loss as a result of such actions or as a result of any act or omission of third parties.

1.3. The Terms and Conditions mentioned here for registration are a complement to the travel plan you are registering for.

1.4. By reaching an agreement with Ataw (Travessioásis – Lda), you acknowledge and accept all the established Terms and Conditions.

2. RESPONSIBILITY

The liability of Ataw (Travessioásis – Lda) is guaranteed by civil liability insurance with Allianz and the Travel and Tourism Guarantee Fund of Turismo de Portugal, under current legislation.

OUR RESPONSIBILITIES

1. Your Booking

Upon receipt of the advance value of the travel that we are customizing for you, Ataw (Travessioásis – Lda) starts the booking process with the respective operators. When validating the reservation, you mandate Ataw (Travessioásis – Lda) so that, on your behalf and representation, it can contact the entities – suppliers of goods and services – responsible for carrying out the trip. Its supply is the responsibility of Ataw (Travessioásis – Lda) or its partners, namely travel agencies, accommodations, carriers or others, according to the agreements entered into and concluded.

2. Price Guarantee

In the customised tours service, the customer defines how much he wants to spend on the experience, and Ataw's fees are always included in the final tour budget, validated by the customer. Prices shown for transport, accommodation, activities, meals and others are based on service costs and exchange rates in effect on the scheduled date and may, therefore, be subjected to change due to changes in transport costs, such as fuel, scheduled fares and any other cost changes of airlines that are part of the submitted proposal. The price of the travel plan shown may also vary due to government action, such as changes in VAT or any currency change imposition in relation to an exchange rate variation.

If you decide to cancel for this reason, you will have the right to do so within 15 days from the issue date printed on the final invoice. If you do that, the value of the advance payment will not be refunded and will have to be applied to another trip to be defined in the future, after subtracting the expenses that we may have already had with bookings.

3. Invoicing

Ataw (Travessioásis – Lda) issues an invoice to the customer exclusively for the amount transferred to us from the previously approved budget, which must be the amount to be transferred to our account, with rare exceptions to be indicated.

The remainder – with few exceptions to be previously indicated and which presupposes articulation between the customer and Ataw (Travessioásis – Lda) – must be paid in the local currency by the customer, and there may be slight exchange differences. In these cases, if the customer wants an invoice, he must request it directly from the local partners.

4. Trip details and Conditions

4.1 As this is a customised tour, all information in the proposal submitted by email is correct to our knowledge, and cannot guarantee, however, that any item mentioned will be available, especially if we do not have direct control over it (supply by third parties, for example).

4.2 Ataw (Travessioásis – Lda) is committed to providing you with the best travel experience, within what we believe is the best quality regarding what was requested by you on the registration form - chosen route, accommodation, transport and hired tours/guides on site.

LIABILITY

All amounts paid to Ataw (Travessioásis – Lda), whether in relation to the advance payment or the remainder of the budget presented, can be used by us at the time we consider convenient and whenever we feel that there is such a need.

YOUR RESPONSIBILITIES

1. Booking your Tour

1.1. In order to guarantee your trip, the payment of at least 30% of the total value of the tour must be made within a maximum period of 7 days from its award, and the remaining amount must be paid within 60 days before the start of the tour, by bank transfer or any other way previously agreed and with proof of payment sent by email. Payment is considered accepted, in part or in full, only after confirmation of the reservation in writing (email or otherwise) by Ataw (Travessioásis – Lda).

2. Tour details and Conditions

2.1. Ataw (Travessioásis – Lda) advises you to carefully read the experience program that is proposed to you and will only be held responsible for reservations that have been requested through the contact form.

No refunds will be made for meals, accommodation, excursions, etc., which you have chosen not to use or when the spaces to be visited are closed.

No amount will be refunded if, for reasons beyond Ataw (Travessioásis – Lda), such as transport delays, unannounced closures, weather conditions or other causes beyond our control, happen and make it impossible to carry out or complete.

2.2. Ataw (Travessioásis – Lda) serves only as an intermediary with the tour operators necessary for booking accommodation, transport, activities and others, refraining from any problem-solving from the moment the service is provided and the product delivered by us.

2.3 You are responsible for any costs incurred as a result of damage or extra cleaning fees related to your accommodation. You are advised to immediately report, as soon as detected, any pre-existing damage in your room to the staff at the accommodation in question and/or to the leader who accompanies you.

2.4 When the traveller occupies a seat in a carriage equipped with a seat belt, the cooperating service providers or operators, agents or organizations cannot be held liable for any illness, injury or death, nor for any loss, damage or claim resulting from any accident or incident if the seat belt is not being used at the time of the accident

2.5 You will need to have a valid passport (minimum 6 months after the date of return) and all visas, personal travel insurance, permits and certificates necessary for the selected experience, as well as all necessary vaccinations and compliance with all applicable laws.

2.6 If you have a complaint regarding your travel experience, you should contact Ataw (Travessioásis – Lda), as soon as reasonably possible, within a maximum period of 15 days after it has ended, so that your complaint can be analyzed. If you do not do so within 15 days, your rights under this agreement may be affected.

3. Insurance

It is mandatory to carry personal travel insurance for the experience. The insurance must relate, at least, to the period of the experience. The fact that you do not have an insurance policy or that it is not the one that serves it, exempts Ataw (Travessioásis – Lda) from any responsibility in relation to the risks and consequent costs that they incur.

4. Disease or Absenteeism

In case you withdraw from the tour after the start of it, due to illness, you must obtain a medical certificate in support of an insurance claim. No refund will be made for the absence in the experience by Ataw (Travessioásis – Lda).

5. Weather Conditions

Under no circumstances will Ataw (Travessioásis – Lda) be held responsible for weather conditions, nor can any experience be cancelled or changed by you at any time, based on weather conditions.

6. COVID-19 Pandemic

Under no circumstances will Ataw (Travessioásis – Lda) be held responsible for occurrences as a result of the Covid-19 pandemic, such as the closure of borders, cancelled or altered flights, closed places to visit, changes in plans during the program, accommodation and/or scheduled transport in advance and closed or cleared without the agency's knowledge. Ataw (Travessioásis – Lda) assumes that the person interested in the trip, upon registration, is aware that we live in uncertain times and that, therefore, Ataw (Travessioásis – Lda) cannot assume any responsibility for services provided by third parties or rules and laws enacted without prior notice.

7. Luggage

Luggage is restricted to a reasonable size and a maximum weight of 20 kilos (except for rare exceptions that will be informed by us), plus a small backpack/bag that can be transported with you.

On trips that include flights as part of the itinerary, it is your responsibility to ensure that your luggage does not exceed the size and weight limits imposed by airlines. We are not responsible for any costs incurred for the excess luggage.


12. Special requirements

Any special requirements must be disclosed to Ataw (Travessioásis – Lda) at the time of booking. Ataw (Travessioásis – Lda) will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to Ataw (Travessioásis – Lda) at the time of booking but we cannot guarantee that dietary needs or restrictions can be accommodated. We are not liable for any failure to accommodate or fulfil any special requests or requirements that do not form part of these Terms or the contract between you and Ataw (Travessioásis – Lda).

13. Acceptance of Risk

You acknowledge that adventure travel and the products and services offered by Ataw (Travessioásis – Lda) may involve a significant amount of risk to your health and safety. By travelling with Ataw (Travessioásis – Lda) you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release Ataw (Travessioásis – Lda) from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in our tour itineraries or otherwise offered by Ataw (Travessioásis – Lda).
